Dismissal of the legal action of the Republic of Austria in the case of State aid support in favour of the nuclear power plant Hinkley Point C

On 12 July 2018 the EU General Court has dismissed the legal action lodged by the Republic of Austria against the Commission decision of 8 July 2014 concerning the financial support to the nuclear power plant Hinkley Point C in the English county of Somerset (see Case T-356/15, ECLI:EU:T:2018:439). The Commission had found that the aid notified by the United Kingdom in connection with the construction and operation of this power plant was compatible with EU State aid rules. The EU General Court, in a very lengthy ruling, rejected all pleas.

It is to be expected that the Republic of Austria will appeal this judgment to the European Court of Justice.
